1. Acceptance of Terms

By purchasing from TrueRife, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not purchase or use our products.

2. Products and Intended Use

• Products are sold worldwide, directly to consumers and businesses.
• Frequency sets, training manuals, and quick start guides are provided strictly for informational and educational purposes only.
• They are not guaranteed to achieve any specific outcome.

By purchasing and using our products, you acknowledge and accept all risks associated with their use, including health, safety, or financial risks. Use is solely at your own risk.

3. Resale Restrictions

• Unauthorized resale or redistribution is strictly prohibited.
• Any resale or redistribution immediately voids all warranties and releases TrueRife from any liability related to the product.

4. Orders and Payment

• We accept Shopify, Shop Pay, Affirm, Visa, Mastercard, American Express, Discover, and other methods available at checkout.
• Orders may be canceled prior to shipment, subject to a 3.5% processing fee.
• Title and risk of loss transfer to the customer upon delivery.

5. Shipping

• Orders typically ship within 48 hours, guaranteed within 72 hours.
• We ship both domestically and internationally.
• Customers are responsible for providing accurate shipping information.
• Once marked “delivered,” TrueRife is not responsible for loss, theft, or damage.

6. Warranty

Our Warranty Policy is incorporated into these Terms and governs all warranty claims.

Key points:

• 1-year standard warranty against defects in materials and workmanship.
• Remedies are limited to repair, replacement, or refund at TrueRife’s discretion.
• Warranty applies only to the original purchaser and is non-transferable.
• Any resale or modification voids the warranty.

7. Returns & Refunds

Our Return Policy is incorporated into these Terms.

• Only items purchased directly from TrueRife are eligible for return.
• Customers have 30 days from delivery to request a return.
• Products must be repackaged with all cords and original documentation.

Refund Conditions:

• Unopened & unused: 10% restocking fee; buyer pays return shipping.
• Used: 20% restocking fee; buyer pays return shipping.
• Heavily used, damaged, or modified products will not be accepted and will be returned at the customer’s expense.

Non-returnable items: Used Ion Pro Waves, Footbath Tubs, Ground Sheets, Soft Ground Mats, Trace Elements Hair Tests, Youthful Energy products.

Laptops: Returnable only if in “like new” condition and resellable as new.

8. Intellectual Property

• All software provided with TrueRife products is licensed, not sold.
• Customers receive a limited, non-exclusive license to use the software solely with the purchased product.
• TrueRife trademarks, logos, designs, manuals, training guides, and frequency sets are protected intellectual property.
• Any reproduction, distribution, or competitive use is strictly prohibited.

9. Relationship with Shopify

TrueRife is powered by Shopify, which enables us to provide our online store and services to you. However, any sales and purchases you make in our store are made directly with TrueRife. By using our store, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and TrueRife, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with TrueRife.

10. Indemnification

You agree to indemnify, defend, and hold harmless TrueRife, LLC, its officers, employees, agents, and affiliates from any claims, damages, liabilities, or expenses (including legal fees) arising from:

• Your misuse of our products;
• Your violation of these Terms;
• Any third-party claims related to your use of our products.

11. Limitation of Liability

To the maximum extent permitted by law:

• TrueRife is not liable for indirect, incidental, punitive, or consequential damages, including lost profits, data loss, or personal injury.
• TrueRife is not liable under strict-liability or product-liability theories.
• Total liability is limited to the purchase price of the product.

12. Force Majeure

TrueRife is not liable for any delays or failures caused by events beyond its reasonable control, including but not limited to natural disasters, government restrictions, labor disputes, supply chain disruptions, or equipment failures.

13. Governing Law, Arbitration & Severability

• These Terms are governed by the laws of Texas.
• Any dispute shall be resolved exclusively through binding arbitration conducted in Montgomery County, Texas, under the rules of the AAA.
• Each party shall bear its own legal costs, and arbitration costs shall be shared equally unless otherwise required by law.
• You waive any right to a jury trial or to bring a class action lawsuit.
• Carve-Out: Either party may bring an individual claim in small claims court in Montgomery County, Texas.
• If any provision is found unenforceable, the remaining provisions remain in effect.

14. Modifications to Terms

TrueRife may update these Terms at any time. Updated Terms will be posted on our website with a new effective date. Continued use of our products constitutes acceptance of updated Terms.

15. Entire Agreement

These Terms constitute the entire agreement between you and TrueRife and supersede all prior agreements, representations, or understandings.
